PROPOSED AMENDMENT: Presidential pardon power The President’s power to grant pardons and reprieves is limited as follows: (a) The President shall not pardon himself or herself, nor a member of his or her family, nor any person whose criminal charge stems from actions performed at the request or order of a President or an official of the national government; (b) The President shall not grant pardons or reprieves to any employee of the executive branch who worked for an administration of which the President was or is a member, for any criminal acts committed by the employee in the employee’s official capacity; (c) The President shall not grant a pardon or reprieve during the last six months of a term of office, for (1) criminal charges that had been filed with a court prior to the beginning of that six months or (2) crimes that have not been charged.
